A law office I worked in was handling a case that involved capitation. In fact, one of the parties said during the course of its litigation, that if our client deducts money from its next capitation check, it will be Seriously Displeased.
I was kind of hoping, in a perverse way, that the next check would have the deduction, if only to watch the fur fly. Civil litigation is sort of like legalized warfare-- the object is to win, and nobody gets hurt, except in the wallet.
